The Judge who had to Abstain

Surinder Dayal was a brilliant engineer. If getting through the gruelling entrance test for Jamalpur (Special Class Railway Apprentices College) wasn’t enough, he went on to top the course and ended up winning the Railway Board Chairman’s Gold Medal. He rose fast in the organisation, got one good posting after the other and landed the plum job of the head of a coach factory in North India. Through diligence and sharp observation, Surinder was able to expose an old ‘temporary recruitments’ racket in the factory. The main accused were promptly identified and summarily discharged.  The ‘aggrieved’ parties of course didn’t take it lying down. They felt that had not only been humiliated but also ‘hit below the belt’. Their long-standing source of income – commissions from the appointees – had been stopped. They had to teach the big boss a lesson; they wanted revenge.

Terrorism in Punjab was at its peak those days. These guys tried to ‘reach out’ to the terrorists; the latter were always on the look out for ‘soft’ clients. In due course contact was established and a “supari” was given out on our friend Dayal. In common parlance, he was ‘already dead’ – it t was only a matter of time. Soon the criminals got their chance. Surinder and his wife Neetu were returning late at night from a wedding in the nearby village. Two guys, one wielding a country pistol, stopped them. The driver was shot first and then our friends. Surinder was hit in the legs and Neetu got a bullet in her neck. Fortunately the headlights of an oncoming bus stopped any further action, and the killers slid away in the darkness. The passengers were extremely helpful. The Railway authorities took charge promptly and swung into action. Our friend and his wife – both critically injured - were transferred, under strict security, to a good hospital in Ludhiana. When the killers learnt that their prey had survived, they panicked. They tried every trick to get near the Dayals, to finish them, but  the security was strict and they couldn’t succeed. The Dayals survived. And thanks to a benevolent Railway Minister, they received excellent treatment and long-term physiotherapy in UK, and recovered rapidly. Though Surinder become wheel chair bound for life, he was fine otherwise. He resumed duty, did well again and finally ended up as a Judge in the Central Administrative Tribunal (CAT). Meanwhile, the case of the dismissed employees (who had gone to court) came up to CAT.  And, you guessed it, the case landed in Surinder Dayal’s lap! That is when Judge Surinder Dayal gave a noting on the file: “Being the victim myself of an attempt to murder, arising out of the dismissals, I am an interested party and can’t hear this case.”
