Fresco Apartment Owners Association has asked the residents to stand united in their fight against the builder, against whom they have launched a legal battle for the take over of the maintenance of the complex. In a major development, the RWA said that they have been able to get an order from the Gurgaon court, whereby the builder can’t switch off the water and power connections of the resident or disconnect these services unilaterally. On this occasion The Fresco RWA also felicitated its counsel, Pooja Aganpal, for representing the case very strongly before the presiding officer, explaining the nuances in detail. Addressing a large gathering of residents, Pooja Aganpal said that they should now start a correspondence with the builder and should tell it to account for the services that are actually being provided to the residents. Aganpal added that they would fight for every right that the residents have as per the Haryana Apartment Owners Act 1983. “If the residents are united and they authorise their Association to deal with the builder on important issues, they will get justice,” she asserted. She said that the builder should provide the details of expenditure on power and water consumption, security and other services paid for by the Association. In fact, since the power connection in the complex is in the name of Fresco Apartment Owners Association, Unitech has no authority to raise bills and collect money for electricity. Col BK Dhawan, member of Core Council of Federation of Apartment Owners Association (FAOA) also asked the residents to stay united and support the Association - both financially and operationally. He said that when the people remain united, the government agencies and officials are forced to listen to their woes. MM Suri, spokesperson, said that the Association will ensure that the problems related to shoddy construction, poor maintenance and lack of security would be tackled most effectively. He also recounted a recent incident in which a master bedroom in one of the flats in Tower 10 had been completely gutted because of an electric short circuit. Notably, the fire alarm system, the smoke detection system and even the fire sprinkler system did not work. The fire extinguishers on the floor were found ‘empty’. The residents also raised the issue of the leakage of cooking gas in the apartment complex, which is a major hazard. It could lead to a fatal accident anytime. It was also alleged that the apartment owners are being made to stay like ‘prisoners’, as the security is too obtrusive – though it lacks any teeth when it comes to safeguarding the people from external threats. Those present included VK Sharma, President of Fresco AOA, Neeraj Bansal, Secretary, AOA; KK Malik, senior member of the Association, Kiran Suri, Vice President, Anurag Verma, Treasurer and Kapil Aganpal, Gurnam Singh, Lakhpat Bhandari, Deepak Nayyar and Harpreet Singh Walia.
